Automatic enrolment duties; Failure to comply has consequences

The Pensions Regulator (TPR) continues to issue warnings, to employers, about the consequences of failing to comply with automatic enrolment duties.

In a recent court case, a pre-school nursery and its director were ordered to pay over £8,000 in penalties. The court issued the penalties for non-compliance and deception.

The company had submitted a false declaration of compliance. The declaration showed that 13 members of staff had been enrolled into a qualifying pension scheme; however, an investigation revealed that no staff were enrolled.

What is the declaration of compliance?

The declaration of compliance tells TPR what an employer has done to comply with their automatic enrolment duties.

If the employer does not submit this to The Pensions Regulator within five months of their staging date, or duties start date if applicable, a penalty may be issued.

Although you have five months to complete it, we encourage clients to start the process as soon as possible after carrying out their automatic enrolment duties. Doing so means there is ample time to put the documentation together accurately, rather than rushing and making unnecessary errors.

In her ruling, the district judge recognised the impact that non-compliance has on both the employee and wider society.

The outcome of this case is another stark warning to employers; there will be unfavourable consequences for those who risk the retirement of savers.
